Our firm handles both insurance and non-insurance construction and construction defect litigation.

Our non-insurance clients are generally construction firms that we have previously defended in insurance litigation, such as general contractors, environmental remediation companies and engineering consulting companies. Our non-insurance practice developed organically through our E&O defence work.

For example, work done by our lawyers has included:

• Representing insurers in disputes between Builder’s Risk Insurance and E&O insurance and CGL insurance, for significant projects such as infrastructure project across Canada, bridge and dam failures, and road work cases;
• Defending general contractors, project managers, and sub-trades including demolition and concrete flooring contractors with respect to claims for damages for alleged defects in their work on condominium, public infrastructure, and design build projects; and
• Defending a concrete/fly ash supplier, with respect to alleged deficiencies in the supply of the product used for the construction of residential homes in the Greater Toronto Area.
